2. Payment Terms, Refunds, and Cancellations
A. Payment Terms
- Our virtual wellness program requires a monthly membership fee of $299 (or a limited-time discounted rate of $99 per month).
- Payment is processed automatically via your chosen method on the billing date.
- You authorize us to charge your payment method for the membership fees until you cancel.
B. Refund Policy
- No Refunds: Payments are non-refundable once processed.
- Exceptions: In rare cases, we may offer a refund at our sole discretion for extenuating circumstances (e.g., medical emergencies).
C. Cancellation Policy
- You may cancel your membership at any time by providing 15 days’ written notice before your next billing cycle.
- To cancel, email us at Support@mindkeeps.com or update your account settings.
- If you cancel, you will have access until the end of your billing period, but you will not receive a prorated refund.
3. Service Limitations (No Medical Advice, Liability Disclaimers)
A. No Medical or Psychiatric Services
MindKeeps provides coaching and wellness support but does not offer medical diagnoses, psychiatric care, or prescriptions.
- Our services are for general wellness and personal growth only.
- We do not provide therapy, mental health treatment, or crisis intervention.
- If you need medical help, seek a licensed healthcare professional or emergency services.
B. Disclaimer of Warranties
- No Guarantees: We do not guarantee that our coaching services will lead to specific mental health improvements or outcomes.
- Use at Your Own Risk: You acknowledge that participation in our program is voluntary and at your sole risk.
C. Limitation of Liability
To the fullest extent permitted by law:
- MindKeeps is not liable for indirect, incidental, special, or consequential damages arising from the use of our Services.
- Our total liability shall not exceed the amount you paid for the Services in the last 12 months.
D. Indemnification
You agree to indemnify and hold MindKeeps harmless from any claims, damages, or expenses arising from:
- Your misuse of our Services.
- Your violation of these Terms.
- Any reliance you place on our coaching or wellness advice.
4. Termination & Dispute Resolution
A. Termination of Services
We reserve the right to terminate or suspend your access to our Services at any time if:
- You violate these Terms.
- Your account is used fraudulently.
- You engage in misconduct, harassment, or any harmful behavior toward our team or community members.
Upon termination:
- You will lose access to our platform and Services.
- You are still responsible for any unpaid fees.
B. Dispute Resolution
If a dispute arises between you and MindKeeps, we encourage you to contact us first to resolve it informally. If a resolution cannot be reached:
- Mediation: Both parties agree to attempt mediation in Tampa, Florida within 30 days.
- Arbitration: If mediation fails, disputes will be resolved by binding arbitration through the American Arbitration Association.
- No Class Actions: You waive your right to participate in class-action lawsuits against MindKeeps.
5. Governing Law & Jurisdiction
- These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
- Any legal action related to these Terms shall be filed in the 13th Judicial Circuit, Hillsborough County, Florida, or the U.S. District Court for the Middle District of Florida, Tampa Division.
- Both parties waive their right to a jury trial for any disputes arising under these Terms.
6. Intellectual Property
- All content on our website, including text, graphics, logos, and digital resources, is the property of MindKeeps or its licensors.
- You may not reproduce, distribute, or modify our content without written permission.
7. Privacy & Data Protection
